Organ donation following medical assistance in dying (MAiD)

Legal and ethical aspects and existing process and processes for MAiD

MAiD is a controversial topic worldwide, and the possibility of organ donation following MAiD has raised many concerns about ethical safeguards and regulations that should be in place to ensure the safety and rigour of this process.  

A two-part scoping review is published in the February 2024 issue of JBI Evidence Synthesis which reports on the legal and ethical aspects of organ donation following MAiD, as well as the existing processes and procedures for organ donation following MAiD.  

To introduce the two-part scoping review in an accompanying editorial, the authors discuss how offering organ donation to patients undergoing MAiD requires consideration of patient autonomy and emotional vulnerability, as well as the importance of having established regulatory frameworks in place. 

“[MAiD] is legally permissible and seen by many as a way to respect patients’ autonomy and help fulfill their last wishes of organ donation. On the other hand, few junctures are as ethically intricate and emotionally intense in health care delivery as the convergence of MAiD and organ donation; therefore, many experts have also raised concerns around the ethics of such a procedure considering the potential emotional vulnerability of patients choosing MAiD.”
